Organ Cave Residents Seek Legal Action

15 people have filed a law suit.

LEWISBURG -- Residents of the small community Organ Cave filled the Greenbrier County Circuit Courtroom. They are trying to stop an annexation bid by Ronceverte.

15 people have filed law suits, including Robert Doering.

"There is much at stake. There is environmental issues with the development itself. There is an annexation of people against their will, and if we don't fight all of Organ Cave will become Ronceverte," said Doering.

Doering says the community does not want to be part of Organ Cave, so they are requesting that Judge Rowe overturn the order.

Judge Rowe decided to postpone the hearing to a later date. A representative from the Stoney Glen Development and West Virginia Farm Properties has requested to intervene.

Judge Rowe set the hearing for August 18.

Interesting fact, that seems to have been missed:

"A representative from the Stoney Glen Development and West Virginia Farm Properties has requested to intervene. "

Ironic that the term "representative" was used in the story. For, the lawyer representing the developer and asking for the intervention is Senator Jesse Guills Jr. Ironic that he is representing an out of state, apparently failed corporation, against the very citizens he was elected to serve.

Another fact:

The development is under a cease and desist order from WVDEP.

Another:

The only lot owner (no house has been started) lists his mailing address in Japan. So, we have the developer from Richmond, VA and the one lot owner petitioning for annexation from Ronceverte. Which will in turn have catastrophic affects on the fragile environment of Organ Cave and the rural community that resides there.

Another:

The Greenbrier County Planning Commission rescinded the subdivision's permit. It is no longer a legitimate subdivision.

Another:

Neathawk Lumber is suing the developer for non-payment of over $14,000 in back bills.

Another:

Ronceverte received a letter from the DOH rescinding its support of the annexation of the roads. Yet they seem to be dead set on pushing this annexation.
