BECKLEY -- The case against Michael Martin, 44, will get a second hearing after review by the West Virginia State Supreme Court of Appeals.
Martin was sentenced to life in prison for his part in the death of Beckley Police Cpl. Chuck Smith. He was convicted of first-degree murder and felony conspiracy.
Smith was killed while performing an undercover drug buy in December 2007.
Martin claimed there was not enough evidence to convict him. The Supreme Court ruled that West Virginia state law does not allow an expert to give an opinion regarding the credibility of a witness.
