WV joins review petition for EPA rule

Posted: Updated:

Gov. Earl Ray Tomblin says West Virginia is joining 21 other states in asking a federal court to review a challenge of new federal air pollution standards.

Tomblin on Monday directed West Virginia Attorney General Darrell McGraw to join a petition for review in the U.S. Court of Appeals in Washington.

The rule by the Environmental Protection Agency rule regulates emissions of hazardous air pollutants from coal-fired electric plants.

Tomblin's office says the rule already has caused electric utilities to announce plans to shut down coal-fired power plants in West Virginia.

Last year, West Virginia joined 24 other states in filing a brief in a lawsuit challenging the rule.
