A Raleigh County woman, involved in a theft that lead to the death of a man is on probation right now.

Judge Robert Burnside sentenced Jennifer Garrison of Crab Orchard to five years probation on conspiracy to commit breaking and entering charges.

Jennifer Garrison and her husband Bernard Joseph Garrison were facing murder charges in connection to the death of Toby Harrah.

Investigators say Harrah was electrocuted while trying to steal copper from the AEP substation in Pemberton on September 16, 2010.

"Under felony murder it does not matter even if no one intended a death to occur it does not matter. When you commit the felony this happens in drug dealing cases often, way too often, people dealing drugs.. Someone gets shot and killed the drug dealer is responsible for that death, even if it was an accident," said prosecuting attorney, Kristen Keller.

Bernard Garrison has yet to be sentenced in this matter.
