Child sexual assault case set for September

Judge Duke Bloom ruled that Justin Hamrick, 23, is competent to stand trial in a sexual assault case involving a then 9-year-old girl.

The Kanawha County Sheriffs department arrested Hamrick back in March.

Investigators said Hamrick sexually abused a girl at Pine Valley Trailer Park in Sissonville.

Neighbors told 13 News they were surprised when Hamrick was arrested.  Some parents said they had a weird feeling about Hamrick when they would see him around the neighborhood.  One mother said she kept her children away from him when he rode his bike around.  Other neighbors said Hamrick would help people around the house.  They said he seemed like a nice guy but that he acted a little strange.

Hamrick has had a handful of competency hearings over the past couple of months.  Multiple psychologists and psychiatrists testified about Hamrick's mental capacity, all with conflicting opinions.

Judge Bloom ultimately deciding that Hamrick is competent to stand trial.  His trial date has been set for September.

Also at the hearing, the state addressed Hamrick's recent probation violations.   Hamrick admitted to a positive drug screen in March. He was previously on probation for a 2010 conspiracy to commit burglary incident.

Judge Bloom revoked Hamrick's probation and sentenced him to one to five years in prison.  He will start serving that sentence immediately.
