Former Lawyer Speaks on NYC Rape, WV Connection

Word traveled pretty quickly all the way from the BIG APPLE to the Mountain State that a man from McDowell County allegedly raped a 73-year-old woman on Wednesday in Central Park.

"The first person I talked to she was describing the crime and I was thinking in my mind please don't be David Mitchell and I said what's the persons name and she said David Albert Mitchell," Sid Bell, McDowell County Prosecuting Attorney said.

Bell said Mitchell was convicted of abduction and kidnapping in Tazewell County in May of 2003. He has also been arrested for first degree murder and sexual assault in McDowell County in 1989. He was acquitted a year later.

"David had a lot of mental health issues growing up as a teenager maybe even younger than that. He needed some very strong long term intervention from a mental health stand point," Bell continued.

Bell recalls when he was Mitchell's lawyer,  Mitchell cold not even write his own name on the police documents. He spelled his name D-A-I-D and after defending his cases, Bell said, he and his co-council knew this wouldn't be Mitchell's last brush with the law.

"We both feared that he would be back in the system again. His life style was such I knew he would be back in the criminal justice system again and I prayed it wouldn't be in this type of situation," Bell said.
