West Virginia State Police announced on Tuesday the sequence of events that they say lead to a delayed response in an alleged copper theft case on Sunday, Nov. 11.

The owner of the Dairy Queen reportedly called 911 around 5:52 p.m. about copper lines that were disconnected from the stores propane tank. Owner Christy Milam told 59News that she learned about the theft when she received a call that power was out at the store.  Her husband apparently caught two people attempting to steal copper. 

Milam called 911, while her husband chased down one of the men and held him at gunpoint.  State Troopers said that the call from Milam was assigned to the Raleigh County Sheriff's Department.  However, according to Troopers, no deputies were available to respond.  Meanwhile, Milam's husband waited for nearly an hour for help from officers before allowing the suspect to go.

911 Operators contacted State Police with the Beckley Detachment at 7:08 p.m., however the Trooper who was covering the Glen Daniel area already had a suspect in custody.  State Police told 59News that dispatchers were notified that the Trooper would respond when he cleared from the arrest.

Milam apparently called 911 again at 7:18 p.m. and was told by dispatchers that no Deputies were available and State Police were asked to respond.  A third call from Milam to 911 came in at around 8 p.m. saying that the suspect had escaped.  State Police said this was the first time they were notified that a subject was being held at gunpoint.

State Police said that a Trooper responded to the scene at 9:20 p.m. and took a report at that time. 

The incident is under investigation by the West Virginia State Police.
