Gov. Earl Ray Tomblin appointed Robert "Rocky" Fitzsimons Dec. 26 to fulfill the vacancy in the First District of the West Virginia Senate for the remainder of former Sen. Orphy Klempa's term, which runs through 2014.

Fitzsimmons' appointment is effective immediately. The district is made up of Brooke, Hancock and Ohio counties as well as part of Marshall County.

Fitzsimmons was selected from a three-name pool that included David Palmer, former Wheeling Fire Department lieutenant, and Same Love of Weirton, who was a member of the House of Delegates from 1983-1996 and currently is a lobbyist.

Fitzsimmons received a bachelor of science degree from Washington University and a law degree from Wake Forest University.

He currently practices law with Fitzsimmons Law Firm PLLC in Wheeling.
