A lawsuit was filed in Kanawha County Circuit Court that alleges sexual harassment of a Fayette County woman by a West Virginia Division of Natural Resources employee.
The complaint filed by Megan Flinn on Dec. 13 said John Bracken, a DNR employee, made persistent and constant sexual comments, questions, graphic sexual jokes and/or other forms of severe sexual harassment. This apparently happened when Flinn began work at Hawks Nest State Park in January 2010.
According to the suit, the W.Va. DNR knew or should have known about the ongoing problems with Bracken. Flinn claims that Bracken created a hostile work environment; discriminated against her because of her gender; sexually harassed her; and violated the West Virginia Human Rights Act.
Also cited in the suit are actions by Bracken, including the slamming of objects around to scare employees, poking people in their heads with his finger or hitting them in the back of the head, despite being asked on multiple occasions to stop.
Flinn is asking for compensatory and punitive damages. She is being represented by Thomas A. Rist, a Fayetteville lawyer. The case has been assigned to Circuit Judge Tod J. Kaufman.
