59News has learned that Brandy Smallwood, the mother of the 2-year-old who was killed on Friday, Feb. 8 at a home in Fairdale, was married to the child's step-father, James Green, just hours before State Police responded to the scene.
Investigators have not made any connection between the couples marriage and the childs death.
James Green appeared before Magistrate Richard Jones at 10:30 a.m. The magistrate ordered him to get a psychological evaluation.
PREVIOUS STORY:
The mother and stepfather of a 2-year-old who was killed earlier this month were in court on Tuesday, Feb. 19.
James Green and Brandy Smallwood had preliminary hearings in Raleigh County. Smallwood is charged with neglect resulting in death. Green is accused of murder.
Troopers said the preliminary investigation revealed that the child was a victim of a "Shaken Baby" incident.
Smallwood and Green both waived their preliminary hearings.
