MCDOWELL COUNTY -

A man was shot Friday afternoon in McDowell County.

But the shooting suspects family said he wasn't just the victim, they said he also fired a gun.

59 News spoke with both sides.

"Harley Riley was standing over there and was hollering over here accusing us of stealing something of his. Then the father came outside, Charlie Kennedy, and said if they wanted to fight they have to fight fair. Harley jerked out a gun and said "I'm not going to fight, I'm just going to shoot you." Charles, the son, walked over there and Harley shot at him and missed. Then the dad got his gun and shot him. He was just trying to get him to put the gun down and fight like a man and he didn't want to do it so he shot one of his son's, so he was defending him because his son didn't have a weapon." said the suspect's daughter-in-law, Emily Hatfield.

This is Harley's side of the story.

"He came out of the porch cussing at me and said that his boys didn't steal my battery charger and I said they're the only ones that has been up there. Every time he does that when he's on pills, he tried to kill his own boys so he took out the shotgun and shot me twice," Harley Riley said.

The shooting face-off happened in the Bullcreek area of Panther.

Police arrested Charles Franklin Kennedy Sr. He's charged with malicious wounding and endangering with a firearm.

McDowell County Sheriff Deputies say the investigation is ongoing and more charges could be filed.
