A former Fairmont State University dean appeared in Marion County Magistrate Court Monday for a preliminary hearing.
Fairmont State University Police arrested Peter Lach, 65, in August and charged him with second degree sexual assault after a man told police that Lach physically restrained him and sexually assaulted him.
The man told police that when he asked Lach to stop, he was shoved and hit his head on a copy machine, according to the criminal complaint.
Magistrate Melissa Linger ruled that probable cause was found.
Prosecutors will present Lach's case to the grand jury in the coming weeks.
