BLUEFIELD -

A non-profit shake up.  The United Way of the Virginia's in Mercer County lost its nonprofit status.  According to leaders in the organization, it's a simple mix up.

We contacted the Secretary of States Office and this is what we found out:

"The Corporate status revoked: December 1, 2008 for failure to pay annual report fee. The Charity status expired: December 8, 2008 (for failure to file final report or to renew) and they have not renewed since. This means that they should not have been soliciting donations or receiving donations from people in West Virginia."

59News spoke with the Executive Director Michelle Carter. She would not speak with us on camera but she said she was unaware of the revoked status by the Secretary of State's Office.

Carter however did state their nonprofit status was revoked by the IRS due to a challenge with a 990 report.  She stated The United Way did submit the reports, but feedback from the government asking for corrections never made it to the office.

The United Way of the Virginia's used to be located in Bluefield, Virginia. But recently they moved its office to Bluefield, West Virginia.  According to executive Carter, the government documents were never sent to either address. Carter said they were sent to an address the united way was never located at.

According to Carter, she was notified by the IRS in April about the paperwork mix up. She stated they have stopped taking donations since they were noticed in April and are working to get their nonprofit status back. But the holdup is the government shutdown. Parts of the IRS are shut down until the government reaches a budget.  So getting that status reinstated could take longer than expected.
