BECKLEY -

A man accused of shooting up homes in Beckley back in 2011 is going through the judicial system for a second time.

Michael Harvey had a pre-trial hearing on Wednesday in front of Judge Robert Burnside.  That hearing was held at 9:30 a.m.  Harvey is accused of five counts of Wanton Endangerment and one count of Retaliation after he allegedly shot at three homes on Canaday Street in Beckley.  The incident happened in April 2011.

Jury Selection in the trial is set to begin on Tuesday, Nov. 5.

Harvey was tried for the charges in April 2013.  However, after nine-hours of deliberation, the jury came back deadlocked.  The case was declared a mis-trial.  Now prosecutors are working through the steps for Harvey's re-trial.
