HUNTINGTON, W.Va. (AP) - A 62-year-old man accused of fatally shooting two brothers south of Barboursville has been found mentally incompetent.
According to The Herald-Dispatch, Rodney Black's evaluation was presented Friday at his arraignment in Cabell Circuit Court. Black is charged with two counts of murder in the deaths of 60-year-old Garrick Hopkins and 61-year-old Carl Hopkins of Oak Hill.
A public defender entered a not guilty plea on Black's behalf.
The brothers were killed Jan. 25 as they toured land that Garrick Hopkins and his wife had purchased.
Black's attorney said a forensic psychological evaluation questioned whether his client could ever be competent to stand trial. Public defender Peter Levy wants Black transferred from a jail to a hospital.
A judge gave the state until next week to respond to the defense request.

Cabell County Sheriff's office have released the names of two people shot and killed in Barboursville, WV on Saturday, Jan. 25
The victims are identified as Garrick Hopkins, 60, of Milton, WV and Carl Hopkins Jr., 61, of Oak Hill, WV. The two men are brothers.
Garrick Hopkins recently purchased the lot adjacent to #12 Lane Drive in Barboursville, WV. He took his brother Carl Hopkins to the lot to show him around.
Deputies from Cabell County say Garrick Hopkins was planning to build on the land.
Rodney Bruce Black, the suspect, says he shot the two men because he thought they had gone into an outbuilding on his property. Black's property is adjacent to the land purchased by Garrick Hopkins.
The outbuilding in question is actually on Garrick Hopkins' land and is not on Black's property.
Additionally, the outbuilding had no property in it belonging to Black.
Black was charged with two counts of murder and remains in the Western Regional Jail, according to the Cabell County Sheriff's Office.
A post mortem examination will be conducted on both Garrick Hopkins and his brother Carl Hopkins by the Cabell County Medical Examiner's office on Monday, Jan. 27, according to a press release issued by the sheriff's office.
According to the Cabell County Sheriff's Department, the shooter, Rodney Bruce Black, 62, was charged with two counts of murder.
Police say the shed was not on Black's property.
The names of the victims are not yet known.
Black is being held in the Western Regional Jail.
According to Cabell County Sheriff Tom McComas, a man shot and killed two men, and called 911 saying that he shot them because he believed they were breaking into his shed.
The suspect was detained and taken to the Cabell County Sheriff's Field Office in Ona, WV to be interviewed.
