BECKLEY - The West Virginia State Police are investigating a case where an elderly man was allegedly abused by his caregivers.

David Small, 34, and Patina Hypes, 48, are charged with Abuse of an Incapacitated Adult and Conspiracy.  The victim, Thomas Moore, was admitted to Princeton Community Hospital with a variety of injuries.  Doctors and nurses at the hospital told State Troopers that Mr. Moore was being treated for "blunt force" trauma injuries.  According the criminal complaint, the victim had injuries to his left ear so that it was "swollen complete shut, and was the approximate size of a softball."  Mr. Moore also had a swollen lip and a black eye.

Moore told investigators that Small and Hypes would hit him on the head with a pan or put him in the shower and throw freezing cold water on him for punishment when he "wets" his pants.  Moore also told Troopers that on the day he was taken to the hospital Hypes and Small were taking turns hitting him in the head and face, while screaming at him.

"Please don't send me back home with them," said Moore in the Criminal Complaint. "they will beat me even more if They know you're here talking to me."
