Federal judge John T. Copenhaver ruled that there is enough evidence that the chemical, crude MCHM, corroded the tanks at Freedom Industries to try the Eastman Chemical Company who provided Freedom with the chemical.
Judge Copenhaver also ruled that American Water, the parent company of West Virginia American Water, could not face repercussions for the 2014 chemical spill into the Elk River that contaminated the water of more than 300,000 West Virginian’s.
The case is set to go to trial on October 25, 2016.
