UPDATE: Pocahontas County magistrate suspended without pay again

UPDATED STORY 2/28/2019 @ 10:30 AM:  The West Virginia Supreme Court of Appeals has suspended a magistrate in Pocahontas County for the second time. 

Magistrate Carrie Wilfong has been suspended from her duties effective Wednesday, February 27, 2018. The court also announced she will not receive pay starting March 2, 2019. The Court states Wilfong was suspended because she is “unable or unwilling to perform her official duties” and “there is probable cause to believe the respondent has engaged or is currently engaged in a serious violation of the Code of Judicial Conduct.” 

Wilfong is prohibited from hearing any further civil or criminal matter or performing any other judicial functions during the pendency of this matter.

Magistrate Wilfong is allowed to request a hearing on the issue.  The case is now with the Judicial Investigation Commission for the filing of formal charges.


ORIGINAL STORY 10/18/2018

The West Virginia Supreme Court of Appeals has suspended a magistrate in Pocahontas County.  The action came after the court went into session on Oct. 4, 2018.

According to an order issued by Chief Justice Margaret Workman, probable cause was found to believe that Magistrate Carrie Wilfong has become unable or unwilling to perform her official duties.  The matter was brought to the attention of the court in a report from Judicial Investigation Commission.

As a result of the order, Magistrate Wilfong was suspended without pay on Saturday, Oct. 13, 2018.  She is not allowed to hear any more civil or criminal matters or perform any other judicial functions while the matter is being settled. 

Magistrate Wilfong is allowed to request a hearing on the issue.  The case is now with the Judicial Investigation Commission for the filing of formal charges.
